Front Door Photo Terms of Service

Scope of this Agreement

This Agreement applies to any photograph, graphics, digital assets, virtual tours, or digital images created or taken by Front Door Photo Media Group LLC, doing business as Front Door Photo (“Front Door Photo”), and delivered to the Client (collectively known as “PHOTOS”) for the property (“PROPERTY”). This Agreement governs the relationship between the parties and in no event shall any e-mail communication or other exchange amend or otherwise modify the terms of this Agreement unless agreed to in writing.

Shoot Preparation

To ensure the best results of the photo shoot please be sure the home is ready prior to the scheduled shoot time. We work on a set time schedule for every shoot.

It is the Client’s responsibility to ensure that the listing is ready for the photo/video/virtual tour to be produced at the arranged time.

  • For liability, Front Door Photo does not handle any cleaning, dusting, or moving of furniture.

  • The agent, manager, or homeowner shall ensure that there are no hazards to the photographer’s safety.

  • Front Door Photo will work with agents and homeowners with regard to pets, but the photographer is not responsible for accommodating pets during the shoot. If pets will be present, please make a note when you order services.

  • Generally, we will be photographing through the entire home. Utility rooms, Garages or closets are typically not included unless requested prior to the shoot.

  • Amenities are not included in a property shoot and fall under separate pricing and licensing. If you require amenities to be photographed please select the package (Community Photos) when booking.

  • Outlining images to describe a property’s location will only be completed when requested by the agent or homeowner, with a limit of outlining only two (2) images. Front Door Photo is not responsible for determining the exact location of the property’s boundaries. Complex property lines may be declined at the photographer’s discretion.

Appointment Timing

Due to traffic conditions and the scheduling of back-to-back appointments, please allow a grace period of approximately fifteen (15) minutes before or after the scheduled appointment time for the photographer to arrive.

Property Access

The Client is responsible for ensuring that the photographer has safe and timely access to the Property at the scheduled appointment time. This includes providing any necessary lockbox codes, gate codes, alarm instructions, parking information, or other access details.

The Client or homeowner shall ensure the Property is ready for photography and that any alarm systems, pets, occupants, or other potential interruptions are properly managed prior to the photographer’s arrival.

Front Door Photo is not responsible for handling alarm systems, securing pets, or supervising individuals present at the Property.

Front Door Photo will take reasonable care while on the Property but shall not be held responsible for issues arising from property access or conditions at the Property, including but not limited to lockbox malfunctions, alarm activation, pets escaping, or other unforeseen conditions.

The Client agrees to indemnify and hold harmless Front Door Photo from claims or damages arising from access to or conditions within the Property outside the control of Front Door Photo.

Weather Policy

There will be times services cannot be completed due to weather. In those circumstances, the Client can choose to continue, cancel, or reschedule the shoot.

If the Client chooses to proceed with photography during poor weather conditions, Front Door Photo will provide the best images possible. If additional outdoor photos are required on a better weather day, the standard reshoot fee will apply.

If, in the opinion of Front Door Photo, the shoot cannot be completed due to inclement weather or other adverse conditions, Front Door Photo reserves the right to reschedule the shoot at the earliest convenience. The Client may accept the rescheduled date or receive a full refund of any deposit.

Cancellation Policy

Cancellations and reschedules are free of charge provided they are made at least twenty-four (24) hours prior to the scheduled shoot.

Same-day cancellations or reschedules are subject to a $35 fee.

Reshoot Policy

Front Door Photo offers reshoots of previously photographed properties for a reduced fee for up to one (1) year after the original appointment, provided that Front Door Photo completed the original shoot.

Reshoots are intended for updated listings or changes to the Property.

Requests made after one (1) year from the original appointment may qualify for a partial shoot at a discounted rate at the discretion of Front Door Photo.

Delivery

Front Door Photo will deliver Photos in JPEG format at a resolution suitable for the licensed use of the images.

It is the Client’s responsibility to verify that the Photos are suitable for reproduction. If the Photos are not deemed suitable, the Client must notify Front Door Photo within five (5) business days. Front Door Photo’s sole obligation will be to replace the Photos at a suitable resolution.

Front Door Photo is not responsible for poor reproduction quality, delays, or consequential damages resulting from the use of the images.

Unless otherwise specified, Front Door Photo is not required to provide images larger than 8”x10” at 300 dpi or deliver images in RAW format.

Front Door Photo has no obligation to retain or archive any Photos after delivery.

Matterport Hosting Policy

Matterport tours created by Front Door Photo will be hosted for six (6) months from the date of creation.

After the six-month period, Front Door Photo reserves the right to deactivate the Matterport tour at its discretion.

The Client may renew hosting for an additional fee or request a transfer of ownership of the Matterport tour at no charge.

Fees and Payment Policy

All fees and expenses are payable no later than thirty (30) business days after delivery of the Photos and are payable regardless of whether the Client makes use of the images.

If payment has not been received within forty-five (45) days, all licensing rights may be revoked at the discretion of Front Door Photo.

If rights are revoked, all images must be removed from any form of advertising or media within ten (10) days and the Client must provide written confirmation that the images have been removed.

Failure to remove the images may constitute copyright infringement and may result in legal action.

Credit card payments are processed on our website through Stripe.

The photo release is not authorized until payment has been received in full.

If the Property is located outside Bay, Gulf or Walton Counties, Front Door Photo reserves the right to add a reasonable transportation fee.

Licensing

Front Door Photo grants the Client a limited, non-exclusive, non-transferable license to use the images for the purpose of marketing the Property.

Front Door Photo retains full copyright ownership of all images and may use them for promotional, portfolio, or marketing purposes.

The license granted is limited solely to the marketing of the Property by the Client who ordered the services. The Client may not sublicense, distribute, sell, or provide the images to any third party for marketing, commercial use, or promotional purposes without written permission from Front Door Photo.

Client warrants that they have the authority to enter into this agreement for the Property and agrees to indemnify and defend Front Door Photo in the event of any litigation arising from this contract.

Listing Transfer

The license granted under this Agreement applies only to the Client who ordered the services.

If the Property is re-listed, transferred, or marketed by another agent, broker, homeowner, or third party, a new license must be obtained.

Front Door Photo may grant a license transfer to a new listing agent for a fee equal to fifty percent (50%) of the original shoot price.

Unauthorized use of the images by any party not originally licensed constitutes copyright infringement.

Product Guarantee and Liability

Front Door Photo guarantees a professionally produced product. If the product created is not acceptable based on reasonable standards, Front Door Photo may refund the Client’s fees. If fees are refunded, the Client is not permitted to use any photographs or media created.

If the product is unacceptable from an editing standpoint, Front Door Photo will re-edit the media once based on written notes provided by the Client. Front Door Photo will make reasonable efforts to accommodate additional editing requests, however specific editing outcomes cannot be guaranteed.

In any event, the total liability of Front Door Photo under this Agreement shall be limited to the total amount paid by the Client for the services provided.

Front Door Photo maintains reasonable liability insurance to protect the contents of the Property from damage caused by its representatives.

Front Door Photo is not responsible for losses or inconveniences caused by malfunctioning web-based technologies.

Website Links

Client is granted a limited, nonexclusive right to create a hyperlink to Front Door Photo’s website provided that no defamatory or derogatory representation is made about Front Door Photo.

Acceptance of Terms

Through the use of this website, you accept the terms and conditions outlined in this Agreement.

If you do not agree with these terms and conditions, you should refrain from using this website.

Continued use of the website following any updates to these terms constitutes acceptance of those changes.
